Present: L. Hendrick, Judge, M.J. Hubble, Clerk, by E.M. Hendrick, his deputy; Anthony F. Church, Coroner; at which the following proceedings were had, viz: The Court appointed H.J. Lindenhower Circuit Attorney, protem, who was sworn as the law directs. The Coroner returned herein the venire heretofore issued with the panel of a Grand Jury. The following persons were sworn as Grand Jurors, viz: Woodson Howard, who was by the Court appointed foreman, Thomas W. Laurence, J.L. Raney, John Breedlove, C. Cannefax, Joel Phillips, David Potter, John Robertson, A.B. Matthews, Thomas Rountree, William Ward, J.P. Moore, Alexander Evans, G,W, Cooper, John Gibson, and C.B. Hensley, who being sworn and charged by the Court retired to consider of their duties.
The following is the order made by the Judge of this Court for this special term

Whereas information has this day been communicated to me that two men, one by the name of William Baker and the other by the name of John Daniels who are charged with Grand Larceny are now confined in the jail of the County of Greene, therefore I, Littleberry Hendrick, Judge of the Circuit Court at said County do hereby order that a Special Term of said Court be held at the Court House in the City of Springfield on the 19th day of this present month (May) for the trial of said prisoners given under my hand this 8th day of May 1862.

P 287 Wednesday May 21st 1862
Court met pursuant to adjournment. Present as on yesterday. Now at this day comes the Grand Jury into Court and through their foreman in the presence of the Grand Jury presents to the Court the following bill of Indictment, viz:
State of Missouri vs Thomas C. Blakey -- Indictment for Robbery,
which by order of the Court was filed and capias issued and forthwith executed by having the Defendant in Open Court. And this cause continued till the next regular term of the Court and Defendant ordered into the custody of the Coroner.
E.B. Gensley and John Gibson, who were sworn as Grand Jurors for this Special Term absented themselves from the Court and refused to serve longer as Grand Jurors, whereupon the following orders were made, viz

Now at this day it appearing to the satisfaction of the Court that C.B. There shall be a new Roll of Attorneys made out and Attorneys duly licensed to Practice Law permitted to sign the same by first taking an oath in open Court to support the Constitution of the United States and that the State of Missouri, and be faithful in their practice.

Now came Alfred Julian, James W. Mack, H.J. Lindenbower, M. Cavanaugh and D.C. Dade, licensed attorneys at Law in Open Court and were permitted to sign the Roll of Attorneys.

Riggs, John J. McQuerter, R.B. Coleman, J.B. Cox, Wilson Keen, M.H. Boren, F. Warren, John Demoth, W.J. Cox, D.J. Hunt, Thomas J. Oneal, twelve good and lawful men who being tried elected and sworn to try the issue joined, heard a portion of the evidence and there not being sufficient time to complete the trial on the present day the Jury were permitted by consent of parties to disperse under the directions of the Court until tomorrow morning at 9 o'clock.

And the Jury not being able to agree as to the guilt or innocence of William Baker were by the Court discharged.

Now again came the Defendant John Daniels into open court who having nothing to say why the judgment of the Law shall not be pronounced against him and all and singular the premises being understood. It is considered by the Court that the Defendant John Daniels who is convicted by the verdict of the Jury for Grand Larceny as he is charged in the Bill of Indictment that he the said John Daniels be punished for the said offence by imprisonment in the penitentiary. But in consideration of the youthfulness of Defendant John Daniels and all the circumstances of the case, it is the opinion of the Court that the punishment of 10 years imprisonment is greater than ought to be inflicted, wherefore it is considered by the Court that the same be reduced for imprisonment for two years instead of ten and that the Coroner convey the said John Daniels to the City of Jefferson and there deliver him to the Keeper of the Penitentiary to be kept in close confinement in the penitentiary for the period of two years. It is also considered by the Court that the State of Missouri recover of and from the Defendant her costs by her in this behalf laid out and expended. And thereupon the Defendant prayed for an appeal from the judgment of the Court in this case rendered to the Supreme Court, which appeal is by the Court allowed. It is thereupon ordered by the Court that the execution of the judgment of the Court be stayed and suspended until a decision of the Supreme Court can be had, and that the Defendant be remanded to the Jail of the County of Greene the keeper whereof is required the said John Daniels to keep safely until he be discharged by due cause of law.

Also, on a due bill against Defendant dated 20th February 1861 for $9. The amount for which Plaintiff claims judgment is $94 and interest thereon. Also, his affidavit stating that the Defendant has absconded or absented himself from his usual place of abode in this State so that the ordinary process of Law cannot be served upon him. Nutt as his securities before Littleberry Hendrick Judge of the Greene Circuit Court and acknowledge themselves to be indebted to the State of Missouri in the sum of $500 for the payment of which they bind themselves their executors and administrations, to be void upon condition that the said Stephen Blackman appear before the Judge of the Greene Circuit Court at the next term thereof which will be held on the first Monday in August, next, and on the first day thereof to answer the charge of an Indictment preferred against him for grand larceny and not depart the Court without leave otherwise to remain in full force.

Now at this day comes the Plaintiff and files his petition verified by affidavit of which is to claim judgment against the Defendants for the sum of $690 and Interest and it appearing that the Defendant Samuel Fulbright has absented himself from his usual place of abode in this State it is therefore ordered by the Clerk, In Vacation, that the Springfield Journal a weekly newspaper printed in the State for four successive weeks, the last insertion to be at least four weeks before the next term of this Court that he be and appear before the Judge of our Greene Circuit Court on the first day of the January Term thereof which commences at the Court House or place of holding Court in Springfield, Greene County, Missouri, on the fourth Monday in January 1863 and plead, answer or demur to Plaintiff's petition or the same will be taken as true and judgment rendered against him and his property which has been attached sold to satisfy the same.
