At a regular tenr of the Greene Circuit Court begun and held at the Court House in the City of Springfield on the 15th day of November A.D. 1847. Present the Hon. Charles S. Yancey Judge, Circuit Attorney ________, William McFarland Sheriff of Greene County and Joshua Davis Clerk.
By virtue of a venire facias the Sheriff returned the following pannel of a Grand Jury herein, to wit: John Murray who was by the Court appointed foreman 2. Charles Poston 3. William G. Roberts 4. Curtis Johnson 5. Martin Ingram 6. Frederick Goss 7. James K. Mlsup 8. B.C. Thomas 9. William W. Andrews 10. James H. Stewart 11. Guien Leeper 12. Samuel Piper 13. David T. Ralston 14. M.J. Rountree 15. Thomas J. Hodges 16. Richard P. Whitlock. Receiving a charge from the Court retired to consider of their presentments.

This day comes the Defendant in this cause by his attorney the Circuit Attorney who prosecutes in behalf of the State of Missouri being also present and the plea in abatement heretofore filed in this cause being taken up and after deliberation had thereon the said plea is by the Court sustained and ordered by the Court said Defendant be discharged and go hence without day.

This day came the Plaintiff in this cause in his own proper person as well as the Defendant and the said Plaintiff says he will no further prosecute his said suit but voluntarily suffers the same to be dismissed and by agreement of the said parties the said Defendant pays the costs. It is therefore considered that the said Plaintiff have and recover of and from the said Defendant his costs in this behalf laid out and ex pended for all of which execution may issue.

Now at this day comes the said Defendant in his own proper person and moves the Court that he as well as his securitys in said recognizance viz: Edward Thompson and James Eastham be discharged from said -recognizance and it appearing to the Court that no Indictment has been found by the Grand Jury of the County of Greene at this Term of this Court against the said Defendant it is therefore ordered by the Court that the said Defendant and his said securities be discharged from said recognizance and that the said Defendant go hence without day. Now at this day come here into Court the Grand Jury of the County of Greene empanelled at this term of this Court and present the following indictments as True Bills
