Now at this day comes the Plaintiff by attorney and it appearing to the Court that the Defendant J.J. Weaver has been duly notified by having delivered to him a copy of Plaintiff's petition and Writ of Summons and having failed to answer plead or demur to Plaintiff's petition the same is by the Court taken as true the Defendant having herein made default. It is therefore considered by the Court that the Plaintiff have an Interlocutory Judgment by default against said J.J. Weaver and that enquiry be had at the next term of this Court and that the same be made final.

It is ordered that publication be made in the Springfield Journal, a newspaper published in this State, for four successive weeks the last insertion at least four weeks hefore the first day of this Court notifying said Defendant that the Plaintiff has commenced a suit against him in the Greene Circuit Court on a promissory note where the amount claimed is $403 and interest and that unless he be and appear before our Greene Circuit Court at the Court House in Springfield, Missouri, on the first day of the next term thereof which commences on the first Monday in January 1865 and answer plead or demur to Plaintiff's petition on or before the sixth day of the term if the same shall so long continue if not then before the end of the term the same will be taken as confessed by him and a judgment rendered accordingly.

Now at this day this cause coming on for a final hearing and the right of a Jury being waived the same is submitted to the Court and the Court having heard and examined the evidence adduced doth find that the said Defendant is indebted to Plaintiff in the sum of $1183.07 debt and also $113 damage. It is therefore considered and adjudged by the Court that the Plaintiff have and recover of and from the Defendant his said debt and damage and also costs, that he have an execution therefor and this judgrnent bear 10% interest. And it appearing to the Court on the 7th day of December 1863 a writ of attachment was issued and by the Sheriff of Greene County on the first January 1864 levied on the following real estate viz W 1/2 Lot No 2 and Lot No 5 NE fcl 1/4 and Lots No 2 and 3 and W 1/2 Lot No 4 NW fcl 1/4 Section No 3 and Lots Nos 3,4 & 5 NE fcl 1/4 Section 4 Township 29 Range 20 in Greene County, Missouri. It is therefore ordered that a special execution against the real estate attached.

Bailey having appeared and plead to Plaintiff's petition but having failed and refused to answer or demur to the amended petition of Plaintiff and the said John McHenry having failed to plead answer or demur to Plaintiff's amended petition the same is taken as confessed by both of said Defendants and the action being founded on two promissory notes given by John McHenry to Plaintiff in part payment for Lots 43 & 44 Block 14 in the City of Springfield, Missouri, and for the enforcement of the same out of said land. Now at this day comes the garnishee ____ Herrington admx and files her answer in this cause.
Now at this day it appearing to the satisfaction of the Court that the Springfield Missourian, a newspaper published heretofore in this County has suspended publication. It is therefore ordered by the Court that all orders of publication heretofore ordered to be printed in said paper and not done be printed and published in the Missouri Patriot.
Ordered by the Court that an adjourned session in continuation of this term be held on the first Saturday before the first Monday in January next.
