Now at this day this cause coming on to be heard and it appearing from the petition of the Plaintiff that the notes sued on were executed by said Defendant to Plaintiff for the following described real estate, viz: commencing at the SE corner Section 14 Township 29 Range 22 and thence West on the section line dividing sections 14 & 23, 40 rods to a beginning point commencing at this point run West 20 rods and North 28 rods on to the center of an alley dividing the lands now owned by Allen Mitchell said Warren H. Graves, thence east along the center of said alley 20 rods, thence South to the place of beginning containing 3 1/2 acres reserving on the side streets and alleys also right of way for SouthWest Branch Railroad.And it also appearing that the Plaintiff had at the time of said purchase executed his bond to Defendant binding himself to make to Defendant a sufficient Deed to said land when said notes were fully paid and it further appears to the Court that said real estate had been sold under an execution in favor of John How against said Defendant and at said sale bought by said John How and it also appears from Plaintiff's petition that the Defendant had since said purchase of the Plaintiff made valuable improvements on said lot and the said Defendant having filed his answer to Plaintiff's petition by which he says the facts stated in Plaintiff's petition are true and that he is justly indebted to Plaintiff the amount of said notes less condition on the same and interest and asks the Court to render judgment for Plaintiff for the same and foreclose the Equity of Redemption in said real estate.The Court therefore sitting as a Jury doth find that the facts above stated as set forth in Plaintiff's petition and as admitted by Defendants answer are true and doth further find from an examination of the notes sued on that Defendant is indebted to Plaintiff in the sum of $675 debt and also $325.25 damage. It is therefore considered adjudged and decreed by the Court that Plaintiff have and recover of and from Defendant his said debt and damage and also costs and that this judgment bear 10% interest and that the Equity of Redemption in said real estate be foreclosed and that the same be sold as the law directs and if after paying the judgment, interest and costs any remain that the same be paid to the said John How and that a special fi fa issue to sell the same and default of said lot paying the same that a general fi fa issue against Defendant for the balance of said execution.

Now at this day comes the Plaintiff by attorney and it appearing to the satisfaction of the Court that the Defendant had been served with notice by publication in the Springfield Missourian, a newspaper published in the State of Missouri for four weeks successively the last insertion at least four weeks before the first day of the present term of this Court and having failed to plead, answer or demur to Plaintiff's petition the same is taken as confessed and this action being founded on a promissory note signed by Defendant the Court doth find from an examination of the same that Defendant is indebted to Plaintiff in the sum of $300 debt and also $77.50 damage. It is ther fore considered by the Court that Plaintiff have and recover of and from the Defendant his said debt and damage as well as cost in this behalf laid out and expended and that a special fi fa issue against the land heretofore attached in this cause, viz.: S 1/2 SW of SE Section Il Township 30 Range 24 NE SW Section 23 Township 30 Range 24 and SW SE Section 23 Township 30 Range 24 SW SW Section 14 Township 30 Range 24 and all or so rnuch therefore as is necessary be sold to satisfy said execution.

Now at this day comes Thomas F. Layton and John L. McCracken and John S. Kimbrough and acknowledge themselves each to owe and stand indebted to the State of Missouri in the sum of $2500 to be levied of their respective goods and chattels, land and tenements for the benefit of the State of Missouri but to be void on condition that the said Thomas F. Layton be and appear at the next term of this Court at the Court House in the town of Springfield and on the first day of said term which will be begun and held on the fourth Monday in January A.D. 1864 and answer to an indictment preferred against him by the Grand Jury of said County for the crime of Treason Against the State and not depart said Court without leave otherwise to remain in full force.

Now at this day comes the Circuit Attorney and also the Defendant in person and by attorney and having announced themselves ready for trial thereupon came a Jury, viz:Josiah Cunningham, E.P. Gott, Jesse Mankins, Eli Spoon, J.R. Ray, W.J. Bradley, William Woodward, L.S. Whitlock, F.M, Watson, N.J. Cox, Alsey oneal and John J. Campbell, twelve good and lawful men who being duly elected tried and sworn to well and truly try the issue joined and having heard the testimony and upon their oath say "We the Jury find the Defendant guilty and assess his fine at $75."It is therefore considered by the Court that the State of Missouri have and recover of and from the Defendant her said fine assessed by the Jury as well as costs in this behalf laid out and expended for which execution may issue.

Whitlock to the following described real estate viz: SW 1/4 SE 1/4 and NW SE of Section 5 Township 29 Range 21, said Whitlock being the purchaser of said land under an execution issued from the office of the Clerk of the Circuit Court for County and State aforesaid in favor of Thomas J. Bailey and against Lemuel H. Freeman.

Now at this day comes Thomas A. Reed, Sheriff of Greene County, Missouri, in to Open Court and acknowledges the execution of a Deed to Colley B. Holland to the following described real estate, viz: a portionof the lot composed of the South halves of Lots 53 & 54 Block No 14 second tier Lots in the City of Springfield begin ning at the SW corner Weirs Lot running South with Main Street to Walnut Street, thence 79 feet East, thence North to Weirs South line, thence West to the beginning said Holland being the purchaser of said real estate under an execution issued from the office of the Circuit Court Clerk of Greene County, Missouri, in favor of John S. Doak against Joshua M. Bailey.
Now at this day comes Thomas A. Reed, Sheriff of Greene County, Missouri, in to Open Court and acknowledges the execution of a Deed to William J. McDaniel to the following described real estate, viz: NE 1/4 NE 1/4 Section 21 and NE SE Section 16 TWP 28 Range 22 said McDaniel being the purchaser of said land under an execution issued from the office of the Circuit Court Clerk of County and State aforesaid in favor of Jacob Garason and against Joseph M. Carthel.

Now at this day comes Thomas A. Reed, Sheriff of Greene County, Missouri, in to Open Court and acknowledges the execution of a deed to Joseph R. Earnest and Zachariah Sims to the following described real estate, viz E1/2 of NW 1/4 Section 12 Township 29 Range 24 in Greene County, Missouri, said Ernest & Sims being the purchaser of said real estate under an execution issued from the office of the Clerk of the Circuit Court of Greene County, Missouri, in favor of J.M. Redfearn and against T.D., M.C., J.A. and J.K. Murray.

Reed, Sheriff of Greene County, Missouri, in to Open Court and acknowledges the execution of a deed to C.G. oneal to the following described real estate, viz NW 1/4 of NW 1/4 and SW 1/4 of NW 1/4 Section 9 Township 30 Range 24 in Greene County, Missouri, said C.G. oneal being the purchaser of said real estate under an execution issued from the office of the Clerk of the Circuit Court of Greene County, Missouri, in favor of John McElhanon and against James McSpadden, George W. Hancock and John Tyler. Now at this day comes Thomas A. Reed, Sheriff of Greene County, Missouri, in to Open Court and acknowledges the execution of a deed to John Small to the following described real estate, viz the NE 1/4 of NW 1/4, the SE 1/4 and NE 1/4 the NE 1/4 of SE 1/4 Section 8, the NW 1/4 of SW 1/4 and SW 1/4 of SW 1/4 Section 9 all township 30 range 24 in Greene County, Missouri, said John Small being the purchaser of said real estate under the execution issued from the office of the Clerk of the Circuit Court of Greene County, Missouri in favor of John McElhanon and against James W. McSpadden, George W. Hancock and John Tyler.
Now at this day comes Thomas A. Reed, Sheriff of Greene County, Missouri, in to Open Court and acknowledges the execution of a deed to J.W. Gately to the following described real estate, viz the SW 1/4 of SW fcl 1/4 and NW 1/4 of SW fcl 1/4 of Section 31 Township 31 Range 21, said J.W. Gately being the purchaser of said real estate under the execution issued from the office of the Clerk of the Circuit Court of Greene County, Missouri, in favor of E.G. Paris admin de bonis non of John Young deceased and against John Lair.
Now at this day comes Thomas A. Reed, Sheriff of Greene County, Missouri, in to Open Court and acknowledges the execution of a deed to Jacob B. Winger to the following described real estate, viz The NW 1/4 of NW 1/4 Section 36 Township 29 Range 22, Greene County, Missouri, said J.B. Winger being the purchaser of said real estate under the execution issued from the office of the Clerk of the Circuit Court of Greene County, Missouri in favor of John Dade and against Thomas D. Wooten.

Now at this day comes Thomas A. Reed, Sheriff of Greene County, Missouri, in to Open Court and acknowledges the execution of a deed to Martin J. Hubble to the following described real estate, viz the SW 1/4 of the SW 1/4 and NW 1/4 of SW 1/4 Section 34 Township 28 Range 29, said M.J. Hubble being the purchaser of said real estate under the execution issued from the office of the Clerk of the Circuit Court of Greene County, Missouri, in favor of The Bank of the State of Missouri against John H. Miller, W.H. Henslee and Joseph M. Carthel.

McQuerter being the purchaser of said real estate under the execution issued from the office of the Clerk of the Circuit Court of Greene County, Missouri, in favor of Nathan P. Murphy against John T. Smith.

Reed, Sheriff of Greene County, Missouri, in to Open Court and acknowledges the execution of a deed to the Bank of the State of Missouri to the following described real estate, viz: part of SE 1/4 of SE 1/4 of SWt Section 36 Township 30 Range 22 said Bank being the purchaser of said real estate under the execution issued from the office of the Clerk of the Circuit Court of Greene County, Missouri, in favor of said Bank of the State of Missouri and against Wiley B. Roper.
Now at this day comes Thomas A. Reed, Sheriff of Greene County, Missouri, in to Open Court and acknowledges the execution of a deed to John R. Danforth to the following describedreal estate, viz: Beginning at the NW corner of the N1/2 of NE 1/4 of SE 1/4 Section 23 Township 29 Range 22 West, thence South 20 feet, thence 383, thence South 146 to a beginning corner,thence East 117 feet 6 inches to a Street, thence 160, Thence West 117 feet 6 inches, thence North 160 feet to the beginning point or corner said James R. Danforth being the purchaser of said real estate under the execution issued from the office of the Clerk of the Circuit Court of Greene County, Missouri, in favor of M.M. McCluer and against David F. Smith.
Now at this day comes Thomas A. Reed, Sheriff of Greene County, Missouri, into Open Court and acknowledges the execution of a deed to Thomas Rountree to the following described real estate, viz: NW 1/4 NW 1/4 NW 1/4 and SE 1/4 NW 1/4 NW 1/4 NW 1/4 NW 1/4 and SW 1/4 NW 1/4 Section 27 Township 29 Range 22, said Thomas Rountree being the purchaser of said real estate under the execution issued from the office of the Clerk of the Circuit Court of Greene County, Missouri, in favor of the Bank of the State of Missouri and against Wiley M. Horton.
Now at this day comes Thomas A. Reed, Sheriff of Greene County, Missouri, in to Open Court and acknowledges the execution of a deed to Thomas Rountree to the following described real estate, viz: A part of NW 1/4 Sect 27 Township 29 Range 22 beginning at SE corner of Section 27, thence West 80 poles, thence North 120, thence East 80 poles, thence 120 to beginning, lying in SW corner of NWt Section 27, so laid out as to leave all the improvements on said 1/4 said Thomas Rountree being the purchaser of said real estate under the execution issued from the office of the Clerk of the Circuit Court

Now at this day comes Thomas A. Reed, Sheriff of Greene County, Missouri, in to Open Court and acknowledges the execution of a deed to David Payne to the following described real estate, viz: NW 1/4 of NE 1/4 Section 21 Township 28 Range 22 W, said Daniel Payne being the purchaser of said real estate under the execution issued from the office of the Clerk of the Circuit Court of Greene County, Missouri, in favor of the Bank of the State of Missouri, in favor of Daniel Payne and against Benjamin W. Cannefax.
Now at this day comes Thomas A. Reed, Sheriff of Greene County, Missouri, in to Open Court and acknowledges the execution of a deed to Tillman Carter to the following described real estate, viz: SW 1/4 of SW 1/4 Section 2 and the SE 1/4 of SE 1/4 Section 3 all in Township 23 Range 23, said Tillman Carter being the purchaser of said real estate under the execution issued from the office of the Clerk of the Circuit Court of Greene County, Missouri, in favor of the Bank of the State of Missouri, in favor of Josiah Leedy and John L. Sharp against William F. Tatum.

Jonathan W. Wilks and William S. Wilks Defendants
Now at this day comes the Plaintiff and it appearing to the satisfaction of the Court that the Defendants cannot be summoned in this cause. It is therefore ordered by the Court that publication be made in the Springfield Journal, a newspaper printed in the State of Missouri for four successive weeks the latest insertion to be at least four weeks before the first day of the next term of this Court notifying said Defendants that suit has been commenced against them by petition in said Court as above recited the object of which is to obtain a judgment against Defendants on a promissory note dated 13th July 1859 payable 12 months after date to Plaintiff for the sum of $100 with interest at 10% per annum from date until paid. And unless they appear at the next term of the Court which will be held on the fourth Monday in January 1864 and on or before the 6th day thereof if the term shall so long continue if not then before the end of the term plead, answer or demur to Plaintiff's petition the same will be taken as confessed.

Now at this day comes the Plaintiffs and it appearing to the satisfaction of the Court that the Defendant cannot be summoned in this cause,It is therefore ordered by the Court that publication be made in the Springfield Journal, a newspaper printed in the State of Missouri for four successive weeks the latest insertion to be at least four weeks before the first day of the next term of this Court notifying said Defendant that suit has been commenced against him by petition in said Court as above recited the object of which is to obtain judgment against Defendant on a promissory note dated January 1st 1861 for the sum of $71.21 with interest at 10% from date until paid and on failure to pay said interest annually the same to be principal and thereafter bear the same rate of interest as the principal and unless said Defendant appar at the next term of this Court which will be held on the 4th Monday in January 1864 and on or before the 6th day thereof if the term shall so long continue if not then before the end of the term and plead, answer or demur to Plaintiff's petition the same will be taken as confessed.
